Local Land Charges Search
What is a Search
Every time a property or piece of land is purchased, or leased, a request for a search is sent to the authority in whose area the property is situated. This is to check any matters affecting the property or land register ed as a Local Land Charge, or information held by the Council that a prospective purchaser tenant or mortgagee would like to know and which may affect its value. A Solicitor or licensed conveyancer usually submit the application for a Local Land Charge Search and Enquiries (con29).
The Official Certificate of Search (Part 1)
Part 1 is called The Official Certificate of Search (form LLC1) and deals with all registerable charges.
Enquiries of Local Authority (Part 2)
Part 2 is called Enquiries of Local Authority ,Con 29 form and deals with such issues as:
- The Planning history of the land
- Road Schemes
- Rights of way
- Various notices which may affect the property
- Advertisements
- Pipelines
From 1st August 2007, the new CON29 (2007 Edition) was introduced. This comprises of Required and Optional parts and customers can submit Optional questions individually if required. Each part is a standalone product that can be ordered separately. However, both parts can still be submitted together.
Q22 on the Optional form relates to common land enquiries previously CR21.
NB Replies are only given on the site area the subject of the search request.
