Ludlow Conservation Advisory Committee

INTRODUCTION

The Ludlow Conservation Area Advisory Committee was set up in December 1987 and has met on a 4 weekly cycle ever since.  It quickly proved its worth because:

  • it was able to provide detailed, expert and well considered advice to the Development Control Committee;
  • it allowed its members to report back to the groups they represent on the views and concerns of the others represented on the Committee.

CONSTITUTION

Name and status

1.  The Committee shall be named the Ludlow Conservation Area Advisory Committee referred to in this constitution as the Advisory Committee.

2.  The Advisory Committee shall have no role or status other than that conferred on it by South Shropshire District Council referred to in this constitution as the Council.

Object

3.  The object of the Advisory Committee is to provide the Development Control Committee of the Council with advice on historic buildings and conservation area matters within the boundaries, or affecting the setting, of the Ludlow Conservation Areas, particularly advice on:

  • applications for planning permission and listed building consent relating to their physical or visual impact on the conservation areas or the specific buildings involved;
  • listed building and conservation area policy relating to the Ludlow Conservation Areas as may be requested by the Council;
  • buildings at risk;
  • possible breaches of planning control and listed building control;
  • schemes to be considered for Ludlow Heritage Awards.

Membership

4.  The Advisory Committee shall have no more than 16 members.  No more than 2 members shall be members of the Council's Development Control Committee..

5.  The members of the Advisory Committee will be appointed by the Council.

6.  The following bodies will be asked to nominate a person to serve on the Advisory Committee:

  • Ludlow Town Council (2 members);
  • Ludford Parish Council;
  • Shropshire County Council;
  • Ludlow Chamber of Trade and Commerce;
  • Ludlow Civic Society;
  • Ludlow Historical Research Group;
  • Shropshire Society of Chartered Architects;
  • Royal Institution of Chartered Surveyors.


7.  Two additional members may be appointed by the Council to the Advisory Committee by virtue of their personal expertise and potential contribution to the work of the Advisory Committee.

8. Casual vacancies on the Advisory Committee, whether arising from resignations, failures to nominate, withdrawal of nomination or any other cause may be filled at the discretion of the Council.

9.  Membership of the Advisory Committee will be voluntary.

Chairman

10. In each Council Year, the Advisory Committee will appoint one of its members who is not a District Councillor to be its Chairman for the year.  In the absence of the Chairman from any meeting, another member will be appointed by the meeting to take the chair.

Secretary

11.  The Secretary of the Advisory Committee will be nominated by the Committee

Meetings

12.  Meetings of the Advisory Committee will be held (if required) every 4 weeks so that any advice given can be reported to the Council's Development Control Committee.

13.  The Advisory Committee does not fall within the definition of a Committee or Sub-committee contained in Section 102 of the Local Government Act 1972.  Consequently Sections 100A-100J of the Act do not apply and the meetings of the Advisory Committee are not open to the public and press.

Finance

14.  The Advisory Committee shall have no resources and shall incur no expenditure.

Amendments

15.  This Constitution may be amended at any time by the Council.
 

AREAS COVERED BY THE ADVISORY COMMITTEE

The areas for which the Advisory Committee has a remit are:

  • Ludlow Conservation Area;
  • Ludlow Galdeford Conservation Area;
  • Ludlow Steventon Conservation Area. 

MEETINGS

Meetings of the Advisory Committee are held every four weeks, programmed 3 weeks before meetings of the Development Control Committee.  This allows any points raised by the Advisory Committee to be addressed by the applicant in time to be reported to the Development Control Committee.

PROCEDURE

The normal agenda of the Advisory Committee includes:

  • matters arising from the minutes which includes reports on any unresolved matters and feedback from the Development Control Committee on the outcomes of applications;
  • consideration of the new applications received in the previous 4 weeks;
  • reports on any buildings considered to be at risk;
  • reports of any alleged breaches of planning or listed building control;
  • special items such as:
    • the Ludlow Heritage Awards;
    • local plan and other policy items;
    • consultation papers.

Because of the short timescales required to meet national standards for processing planning applications, it is not possible to report third party correspondence to the Advisory Committee.  Representations on applications considered by the Advisory Committee should be made to the Council in the normal way.
