Pollution control - Chimney Height Approval
Industrial and Commercial Chimney Heights
Certain chimneys serving industrial or business furnaces or boilers require approval from the Council before they are first used. This requirement is under the Clean Air Act 1993 sections 14 and 15. The purpose of this is to allow the Council to ensure that the proposed chimney is high enough to allow adequate dispersion of the flue gases so that a nuisance will be avoided.
This approval is separate from any Building Regulation approval that may be required under the Building Acts.
The procedure applies to chimneys serving commercial or industrial furnaces/boilers used to burn the following fuels:
- Pulverised fuel
- Any solid matter at a rate of 45.4 kilograms/hour or more
- Any liquid at a rate of 366.4 kilowatts/hour or more
- Any gas at a rate of 366.4 kilowatts/hour or more
There is no charge for a Chimney Height Application, which should be made on an application form available from the Council or may be downloaded below. The Council aims to determine any application within 4 weeks, but further information may be required during the application process which could delay this. Applicants should use the 3rd Edition of the Clean Air Act Memorandum 'Chimney Height' publication to establish the height of any chimney proposed, and may be required to submit details of the calculation during the processing of the application.
